APPLICANT REQUESTS THAT:

Change her date of separation from the Regular Air Force from 11 May 13 to 19 Jun 13 to eliminate her break-in-service. 



APPLICANT CONTENDS THAT:

Through no fault of her own, due to an erroneous transfer into the IRR and resulting delay in processing her Air National Guard appointment, she unjustly incurred a break-in-service between her date of separation (DOS) from the active duty and the date he was gained into the Air National Guard (ANG).

STATEMENT OF FACTS:

The applicant received an Honorable discharge from the Regular Air Force on 11 May 13. 

Effective 20 Jun 13, the applicant was appointed into the Air National Guard.  

The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility (OPR) which is included at Exhibit C.



AIR FORCE EVALUATION:

NGB/A1PO recommends granting the applicant’s request to adjust her separation date to 19 June 2013.  The applicant separated from the Regular Air Force on 11 May 13, but she was incorrectly transferred to the Air Force Reserve instead of directly into the ANG.  She should not have been assigned to the Air Force Reserve.  The Air Force Reserve was not able to scroll her for appointment into the ANG, causing a delay in her appointment, which was not her fault.  She was eventually appointed into the ANG on 20 Jun 13.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 30 May 14 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).



THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice.  We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief should be granted.   Therefore, we recommend the applicant’s records be corrected as indicated below.  



THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show the applicant was not released from active duty on 11 May 2013, but on that date she continued to serve on active duty until 19 June 2013, when she was released from active duty and transferred to the Air National Guard, effective 20 June 2013.
